What this chapter covers

This chapter covers coffee, tea, mate and spices, whether roasted, dried, crushed or ground. Mixtures follow a clear rule: a blend of two or more products of the same heading stays in that heading, while a blend drawn from different headings goes to 09.10. Adding other substances does not change the classification unless it alters the essential character of the product.

• Coffee, whether or not roasted or decaffeinated, its husks and skins, and coffee substitutes containing coffee (09.01)
• Tea, whether or not flavoured (09.02)
• Pepper of the genus Piper and dried, crushed or ground fruits of the genus Capsicum or Pimenta (09.04)
• Vanilla, cinnamon and cinnamon-tree flowers, and cloves (09.05–09.07)
• Nutmeg, mace and cardamoms (09.08)
• Seeds of anise, badian, fennel, coriander, cumin, caraway and juniper berries (09.09)
• Ginger, saffron, turmeric, thyme, bay leaves, curry and other spices (09.10)
• Mixtures of products of headings 09.04 to 09.10 (those spanning different headings fall in 09.10)

Not covered by this chapter

• Cubeb pepper (Piper cubeba) and other products of heading 12.11
• Mixtures containing added substances that change their essential character; flavouring or seasoning blends of that kind fall in 21.03

1. 09.04 ila 09.10 pozisyonlarına giren ürünlerin birbirleriyle olan karışımları aşağıdaki şekilde sınıflandırılır:

(a) Aynı pozisyonda yer alan iki veya daha fazla ürün karışımları o pozisyonda sınıflandırılır.

(b) Farklı pozisyonlarda yer alan iki veya daha fazla ürün karışımları 09.10 pozisyonunda sınıflandırılır.

09.04 ila 09.10 pozisyonlarındaki ürünlere [veya yukarıdaki (a) veya (b) bentlerinde belirtilen karışımlara]

başka maddelerin katılmış olması, bunların esas özelliklerini değiştirmedikçe, sınıflandırılmalarını

etkilemez. Aksi halde, bu karışımlar bu fasılda sınıflandırılmaz; bunların lezzet veya çeşni verici

yapıdaki karışımları 21.03 pozisyonunda sınıflandırılır.
